Consumer Class Actions: IT Overtime Investigation
We are currently investigating claims for a potential class action. These claims involve situations in which Information Technology workers are falsely identified as exempt from certain compensation requirements defined in the Fair Labor Standards Act and consequently denied federal overtime wages.
In order for the Computer Employee Exemption to be applicable, the primary duties of a position must be: systems analysis, programming or the engineering of software (development and design). Workers whose primary duties do not meet specific requirements may be entitled to proper overtime compensation.
